Arkansas State University-Jonesboro ("ASUJ") has created a website containing the resumes of former student athletes who are seeking employment in various fields. ASUJ desires to have businesses or other persons ("Subscriber") subscribe to the website in order to gain access to the resumes for former student athletes. Subscriber shall not seek to hire a student athlete for a job that does not comply with applicable state and/or federal law.
The resumes that are posted to the website were created by former ASUJ student athletes and provided to ASUJ for the sole purpose of posting on the website. ASUJ makes no changes, additions or deletions to what is provided to ASUJ. Subscriber understands that any inquiry as to the relevant experiences and qualifications of any former student athlete is the responsibility of the Subscriber and that ASUJ is not responsible for such an inquiry.
ASUJ reserves the right to terminate a user's access at any time and without explanation. The user may request reinstatement by emailing firstname.lastname@example.org.
Subscriber shall not sell, resell, transfer, assign or distribute, or make available to any third party, access to the website. If Customer knowingly allows a third party access to the website, ASUJ shall have the right to terminate this agreement immediately. Assignment may be permitted upon written consent of ASUJ.
Nothing contained in this agreement shall be construed as a waiver of the sovereign immunity of Arkansas State University-Jonesboro. Any claims for damages made against Arkansas State University-Jonesboro shall be filed in the Arkansas State Claims Commission. Any other action filed against Arkansas State University-Jonesboro arising out of this agreement that does not seek damages shall be filed in the Circuit Court of Craighead County, Arkansas.
In the event that ASUJ is unable to provide website access because of any event reasonably beyond its control, including without limitation, acts of God, ASUJ will promptly give notice to the Customer and shall take all measures to resume performance. If the period of time that the website is not accessible exceeds 30 days then the Subscriber may give written notice to ASUJ terminating this agreement effective immediately.
